TERMS AND CONDITIONS

By providing us with your personal data, you accept and authorize GREEN HOPPER® to use and process your personal data and information automatically, which will become part of our database, guaranteeing the protection and privacy of the same, through their legitimate, controlled, and informed processing, and your right to informational self-determination.

Employee data or individuals seeking employment: In addition to the above, information generated during recruitment, selection, and hiring processes, work history, educational background, titles, professional licenses, certificates, awards, hobbies, interests, etc.

SENSITIVE PERSONAL DATA:

We inform you that GREEN HOPPER® does not collect sensitive data from its customers, employees, or third parties.

 

6.- OPTIONS AND MEANS WE OFFER TO DATA SUBJECTS TO LIMIT THE USE OR DISCLOSURE OF DATA:

GREEN HOPPER®, in order to safeguard your information in the best possible way, undertakes to process your personal data under strict security measures to guarantee its confidentiality. Standards of security have been established in administrative, legal, and technological matters to prevent unauthorized third parties from obtaining your personal data.

You may also request to be included in our “NO ADVERTISING” exclusion list, so that your personal data are not processed for marketing, advertising, or commercial prospecting purposes by us, by sending an email with the subject “EXCLUSION LIST” to the email address ventas@greenhopper.com.mx indicating such request.

It should be noted that the data subject may initiate an Access, Rectification, Cancellation, or Objection (ARCO) procedure to limit the use or disclosure of their data in accordance with section 8 of this privacy notice.

Submit your request by sending an email with the subject “EXERCISE OF ARCO RIGHTS” to the email address ventas@greenhopper.com.mx addressed to Alan Gómez, in his capacity as responsible for handling your requests.

The data and documentation that must be attached to your request are:

• The name of the data subject, their address, and an alternative means to communicate the response to their request.
• Documents proving the identity of the data subject or, if done by a third party, proving legal representation.
• A clear and precise description of the personal data regarding which one of the ARCO rights is sought
• Any other element or document that facilitates the location of your Personal Data. In the event of requests for rectification of personal data, the data subject must indicate the modifications to be made and provide documentation supporting their request.
• If it is noted that the documentation has strikeouts, alterations, or there is reasonable doubt about its authenticity, whether it is not the data subject or not the legitimate representative, GREEN HOPPER® reserves the right to request any other document or action to verify and accredit the ownership of the data, so you may be asked to present the documentation in original or certified copies at the office of the controller. If any information is missing in your request, you will be asked to correct the omission promptly.

If you comply with all the formalities required for this procedure, a response will be provided within a maximum period of twenty days, counted from the date on which your request was received or from the date on which all the precautions were fully corrected. The aforementioned period may be extended only once for an equal period, provided that the circumstances of the case justify it, in accordance with Article 32 of the law in question.

 

9.- IN CASE OF DATA TRANSFERS:

We inform you that GREEN HOPPER® does not transfer information to third parties without your prior authorization.

Transfers may only be made without your consent in accordance with the provisions of Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties, and this transfer must comply with the terms established by said law. We establish the following assumptions:

• When the transfer is necessary for the prevention or medical diagnosis, the provision of medical assistance, medical treatment, or the management of health services.
• When the transfer is made to controlling, subsidiary, or affiliated companies under the common control of the controller, or to a parent company or any company of the same Group as the controller that operates under the same internal processes and policies.

• When the transfer is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice.
